Tranny filter and fluid overfilled

I'm not very good at tranny; therefore, I need all help that you could give. And please do.

1) Could anyone please tell if the '95 SC400 with 138,000 miles needs a tranny filter change? Is it necessary because its tranny filter never got changed? Is there a kit to change it? I talked to a tranny specialist and he said that I don't ever have to change its filter unless I replace the torque converter. Is this true?

2) Also, my tranny fluid drips on the ground, and as I checked the dipstick level, it was almost 1" overfilled. Is this what caused the fluid to drip out of its container? And will it cause any harm to the tranny?

You should be changing the tranny filter every couple of years.
They are only about $20USD.

Did you check the tranny fluid with the motor running?
There is a specific way to check the tranny fluid level, you can't just open the bonnet and pull the dipstick.
Search the web for how to check the fluid level (its not specific to Lexus, is just specific to Auto's. ie, its not the same procedure as checking engine oil).

As for the leak, find out where its leaking from.
Pan seal, front seal, rear seal, cooler lines, pan plug?
 
Yes, I checked the tranny fluid level while the engine was cold. I guess that I should check it while it's fully warmed up. The fluid drip is along the dipstick pipe so I don't know where it came from. Is the tranny filter located right above the tranny pan? Do I need the tranny pan gasket also?
 
Filter is just above pan.
Not sure about gasket, some people say to use them, some people say don't bother.
